Terms and conditions

§ 1 Provider and scope

These terms apply to ShortsForge (shortsforge.de), operated by Noah Kaulfuß, Am Lerchenberg 44, 74199 Untergruppenbach, Deutschland, noah.kaulfuss@outlook.de. They apply to consumers and businesses using the service.

§ 2 Service

ShortsForge converts uploaded videos into vertical short videos (Shorts). Depending on the plan, this includes cropping, layouts, trimming, colour profiles, subtitles and upload to YouTube. We provide the service as it currently stands; a specific availability is not guaranteed.

§ 3 Contract and account

You sign up with an email address through our sign-in provider. The free plan starts when you sign up. A paid plan starts when the payment at Stripe is completed. You may not pass your account on to others.

§ 4 Plans and limits

Free: 15 Shorts per calendar month, with watermark. Starter: 9 euros a month or 90 euros a year, 60 minutes of video per calendar month, no watermark. Pro: 19 euros a month or 190 euros a year, 120 minutes of video per calendar month, no watermark, with automatic subtitles.

The founder price gives 25 percent off the Pro plan for the first 12 months while spots are available (50 at most), and applies to monthly billing only. It ends when you switch to yearly billing.

Limits apply per calendar month. Unused allowance does not carry over.

§ 5 Prices and payment

All prices are in euros. We are a small business under § 19 UStG (German Kleinunternehmer rule), so no VAT is charged. Stripe processes payments (card or PayPal). Monthly plans are billed monthly, yearly plans yearly in advance. The subscription renews automatically until you cancel it.

§ 6 Term and cancellation

You can cancel a monthly subscription at any time, effective at the end of the current billing period. A yearly subscription runs for 12 months and then ends unless you cancel before the term ends. You cancel with the "Cancel subscription" button or in the Stripe customer portal, which you find on the pricing page under your plan. Access to paid features ends with the term.

§ 7 Uploaded content

You keep all rights to your videos. You confirm that you hold the rights to the picture, sound and music you upload and publish, and that your content does not break any law or YouTube's rules. We may process the content only as far as the service requires.

§ 8 Liability

We are liable without limit for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For ordinary negligence we are liable only for breach of essential contractual duties, and then limited to the foreseeable damage typical for the contract. For data loss we are liable only to the extent the loss would have occurred even with regular backups by you.

§ 9 Right of withdrawal

Consumers have a right of withdrawal. The notice is on the page Cancellation notice (Widerruf).

§ 10 Changes to these terms

We may change these terms. We inform you at least 30 days in advance by email to the address you gave at sign-up. If you do not object within that period, the new terms apply. The notice points out this right to object.

§ 11 Final provisions

German law applies; for consumers, this does not affect mandatory protections of their country of residence. If a provision is invalid, the rest remains valid. We are neither obliged nor willing to take part in consumer dispute resolution (§ 36 VSBG).
